I bought this Toshiba TV about a week ago and now I want to return it so now I got the TV back to the store but the workers there did not want to return it, and they told me that on the receipt is says that is final sale. And they said thats why I cannot return the damn thing. So I want to know if I was to sue them for not returning the tv eventhough it says on the receipt that it is final sale would you think I would win. The damn TV costs more than 3500 hundred dollars.

Sorry, you can't sue them. The sales receipt is a binding contract and if the contract says "All sales are final." then you are stuck with it.
If you really got to get rid of it then try eBay. Of course you will take a loss on it, but that's the price you pay when you don't read all of the fine print on such a major sale. (One key to doing well on eBay is to load up on the shipping charges--to a lot of people that is the equivalent of fine print.)
Reply:Unless the television has an obvious defect or malfunction,your chances of suing and winning are just about zero. They covered their asses when they printed all sales final on the receipt. I never purchase a big dollar item at a store that has no return policy or exchange only policy.

Reply:Sorry, you had it written on the receipt that it was a final sale. It is the consumer's responsibility to make sure they know what they are getting into before making a major purchase like that. My suggestion to you, next time you buy something that costs more than you are willing to "lose", make sure you ask about their return policy. Most places have them written down in a visible place, if not then ask for a copy of their policy for future reference.
Reply:When the sale is final on a receipt, it usually means that they don't want the problems associated with an item if it breaks (can you blame them?)
That's why there's warranties....
However, if it broke within a certain amount of time, and they are unwilling to help - you could still have rights since the purchase is under 30 days.
I wouldn't give up - climb the corporate chain, it wouldn't hurt to make a few calls, although I assume in the end you will have to work it out with Toshiba or whoever is covering your warranty. Hurry and call them too, because I think within 30 days sometimes they have to provide a new replacement, isntead of fixing it. YMMV depending on the warranty and the product though.
